These terms (“Terms”) apply because you are accessing a platform operated by Nistula Reality Solutions Private Limited, whether it’s through our website, micro-site, digital experiences, social media platform, mobile applications, or any other services and products offered by Nistula Reality Solutions Private Limited (“Platform”).
These Terms constitute a legally binding agreement between you (“you,” “user,” or “guest”) and Nistula Reality Solutions Private Limited (“Nistula,” “we,” or “us”) governing your use of the Platform, including any content made available therein (as defined hereinafter). If you do not agree to these Terms, you must refrain from accessing or using the Platform for any purpose.
Certain products, services, sections of the Platform, or specific content and transactions may be subject to additional policies, terms, or conditions, which will be made available in the relevant areas of the Platform. These additional policies, together with these Terms, shall govern your access and use of those sections. All such supplementary policies, terms, and conditions are incorporated herein by reference. In the event of any conflict between these Terms and the additional policies or terms, the latter will take precedence for the specific areas in question.
Nistula retains the right to terminate or revoke any user’s account in the event of a breach of these Terms or any related policies posted on the Platform.
Unless otherwise stated in additional terms and conditions, these Terms take precedence over all prior representations, agreements, or understandings. They shall remain authoritative despite any inconsistencies with other terms associated with orders placed or services rendered by Nistula.
Your use of the Platform is governed by our Privacy Notice, which is incorporated into these Terms by reference and outlines how Nistula collects, uses, discloses, and processes personal information. We reserve the right to amend these Terms and/or our Privacy Notice at any time, as we deem appropriate, without prior notice to you. Therefore, we recommend that you periodically review both documents to remain informed of any updates. Your continued use of the Platform following any changes to the Terms or Privacy Notice will constitute your acceptance of the revised versions.
The Platform may only be used and transactions conducted by individuals who are capable of entering into legally binding contracts under the Indian Contract Act, 1872. While access to the Platform is free, you must register with Nistula and create a personal account before purchasing any products or utilizing our services. You are required to provide accurate, complete, and up-to-date registration information, and it is your responsibility to promptly update this information as changes occur.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to (a) promptly inform Nistula of any unauthorized use of your account or any breach of security, and (b) ensure that you log out of your account at the end of each session. Nistula shall not be liable for any loss or damage arising from your failure to comply with these obligations. You may be held accountable for any losses incurred by Nistula or other users of the Platform resulting from either authorized or unauthorized use of your account due to your failure to safeguard your account information.

Post, transmit, redistribute, upload, or promote any communications or content that may harm or adversely affect our business, products, or services.
Engage in any activity or utilize any means that restricts, impairs, interferes with, or inhibits other users from using or enjoying the Platform, or that compromises the security of the Platform.
Use any device or attempt to deploy any engine, software, tool, agent, script, or other mechanism (including, but not limited to, spiders, bots, crawlers, avatars, or intelligent agents) to navigate or search the Platform or to copy any content from it.
We reserve the right to immediately restrict your access to the Platform and terminate your account if you violate this provision or any other terms outlined herein.
All information accessible to you as part of or through your use of the Platform, including but not limited to data files, written text, computer software, music, audio files, photographs, videos, or other images, is the sole responsibility of the individual or entity from whom such content originated. Collectively, all such information shall be referred to as “Content.”
All Content available on the Platform may be protected by intellectual property rights owned either by Nistula or by third parties who have provided that Content to Nistula, or by other individuals or entities representing them. You are expressly prohibited from using, altering, modifying, assigning, licensing, loaning, selling, distributing, or creating derivative works based on this Content, whether in whole or in part, unless you have received prior written authorization from Nistula or the rightful owners of such Content.
Nistula is committed to respecting the intellectual property rights of others. If you believe that there has been an infringement of your rights on the Platform, we kindly ask you to provide us with a written notification that includes the following information:
A clear identification of the copyrighted work that you claim has been infringed.
The specific location of the infringing material on the Platform, including, but not limited to, the link to the infringing content.
Proof of your ownership of the alleged copyrighted work.
Your contact information.
Please note that the inclusion of any products or services on the Platform at any given time does not guarantee their availability in the future. We reserve the right to discontinue any products or services at our discretion.
You are encouraged to carefully review the descriptions of the services and products prior to making a booking. By proceeding with a booking, you agree to adhere to all conditions outlined in these Terms, as well as any additional terms and conditions that may be applicable. If you are making a booking on behalf of another individual, it is your responsibility to inform that individual of these Terms, including all relevant rules and restrictions. Furthermore, you represent that you will comply with all applicable laws and regulations of the relevant jurisdiction regarding the use of services for each transaction.
Services are offered on an “as is” and “as available” basis. We reserve the right to modify the features or functionality of the services at any time, at our sole discretion, without prior notification. Nistula expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. No advice or information, whether oral or written, obtained from Nistula or through the services provided shall create any warranty that is not expressly stated in these Terms or in the service-related terms and conditions.
Additionally, you authorize Nistula’s representatives to contact you via phone, message, or email. This consent overrides any preferences you may have registered with the National Customer Preference Register (NCPR) or any similar preference management systems.
A booking will be considered confirmed only upon receipt of 100% payment from the guest. Once payment is completed, Nistula will issue a Booking Confirmation Voucher, which serves as the guest’s authorization to check in at the property for the confirmed dates. Please be advised that check-in will not be permitted without the issuance of this voucher.
Nistula will make every reasonable effort to accommodate requests for modifications or changes to bookings; however, some changes may not be feasible. Additional charges may apply in certain cases. Please note that any reduction in the length of stay will be subject to the terms outlined in the cancellation policy.
If you wish to cancel your reservation, you must provide written notice via email or through our official communication channels as listed on our website. The cancellation will be considered effective from the date we receive your written notice.
A full refund will be issued for cancellations made up to five (5) days prior to the scheduled arrival date.
A 50% refund will be provided for cancellations made at least 48 hours before the scheduled arrival.
No refund will be granted for cancellations made within 36 hours of arrival or in cases of no-shows.
Refunds are subject to the terms and conditions specified in our Cancellation terms. Please review the Cancellation Policy for detailed information regarding deadlines and applicable fees. To qualify for a refund, you must cancel your reservation within the timeframe outlined in the Reservation Cancellation Terms.
Refunds may be granted in exceptional circumstances, such as documented medical emergencies, natural disasters, or other unforeseen events beyond your control. Appropriate supporting documentation may be required to validate such claims.
If you cancel your reservation within the specified cancellation window, we will refund the applicable portion of the reservation cost, excluding any non-refundable charges or fees. Refunds will be processed using the original payment method used during the reservation. However, we reserve the right to issue the refund via an alternative method, such as a bank transfer or company-issued check, if deemed necessary.
In certain situations, instead of issuing a refund, we may offer a credit towards a future reservation, subject to availability and the following terms:
The credit must be redeemed within 60 days from the date of the original reservation’s cancellation.
The credit is non-transferable and may only be applied toward a reservation at one of our properties.
If the cost of the future reservation exceeds the value of the credit, you will be responsible for paying the difference.
If the cost of the future reservation is lower than the credit amount, no refund or additional credit will be provided for the unused balance.
Certain charges and fees may be non-refundable, as outlined in our Cancellation Policy. These may include, but are not limited to, processing fees, administrative costs, or fees related to additional services or amenities requested during your stay. Any non-refundable charges will be clearly disclosed at the time of booking or as specified in our Cancellation Policy.
We strive to process refunds as quickly as possible. However, please allow up to five (5) business days for the refund to be reflected in your account, as processing times may vary depending on the payment method and your financial institution.
Standard check-in time is 14:00 Hrs, and check-out time is 12:00 Hrs.
If you anticipate an early arrival and require immediate access to your room(s), we recommend booking the room for the night prior to your arrival. Similarly, for late departures, reserving an additional night will ensure access to your room until your departure.
Early check-in before 12:00 Hrs will incur additional charges.
Late check-out after 14:00 Hrs will incur additional charges.
Requests for early check-in or late check-out are subject to villa availability and are granted at the sole discretion of Nistula. Such requests must be communicated to the Nistula team in advance.
Guests will not be allowed to remain on the property beyond the check-out time specified in the Booking Confirmation.
The price at which the Guest makes the booking will remain fixed, even if Nistula adjusts the pricing on its platform after the Guest’s booking has been confirmed. No refunds will be issued due to any subsequent price changes, including rate fluctuations that may impact the rental cost. Nistula reserves the right to impose any additional taxes or charges implemented by government or regulatory authorities that were unknown at the time of publication. In such an unlikely event, Nistula will notify the Guest if any such taxes or charges become applicable to their booking.
Guests are required to pay a “Security Deposit” by a specified date, determined by Nistula on a case-by-case basis, to ensure the proper and safe use of the property. This deposit may be used to cover any damage or loss to the property, including but not limited to guest-caused damages, additional cleaning requests, furniture rearrangement, or extra service calls outside of standard hours. If no damages or issues are identified, the deposit will be refunded to the guest after check-out. Nistula will provide advance notice of the deposit amount and any other applicable terms. Failure to pay the full security deposit may result in denied access to the property.
By making a booking, Guests acknowledge and agree that they do not and will not hold any claim to possession of the property at any time. Guests will not be granted access to the property until all required conditions and obligations have been fully met. Failure to comply with these requirements will result in denial of check-in, and no refunds, compensation, or deposits will be returned to the Guest by Nistula or the property owner.
In the event that Nistula discovers any false or misleading information provided by the Guest during the booking process or at any time thereafter, Nistula reserves the right to revoke the booking. Entry to the property will be denied, and if the Guest has already checked in, they and their accompanying parties will be evicted. In such cases, no deposits or payments will be refunded, and no compensation will be provided.
The number of Guests and visitors at check-in or during the stay must not exceed the number specified at the time of booking or as indicated in the booking confirmation or reservation voucher. Nistula reserves the right to refuse check-in or evict Guests if the occupancy exceeds the stated limit, with no refund of deposits or advance payments. Nistula, at its sole discretion, may allow additional persons at an extra charge, but only if prior written approval has been granted by Nistula.
The check-in and check-out times are as specified in the Booking Confirmation and must be strictly adhered to. Nistula advises Guests to avoid arriving at the property before the designated check-in time. Should a Guest arrive and enter the property before the stated check-in time, or before an alternate time agreed upon in writing by Nistula, additional charges will apply.
If an alternate check-out time is approved by Nistula, it will be explicitly communicated in writing within the Booking Confirmation. Guests will not be permitted to occupy or remain at the property beyond the check-out time specified in the Booking Confirmation.
Guests must thoroughly inspect the property and report any existing damages to the premises or its contents (such as appliances, furnishings, cutlery, crockery, furniture, fittings, or fixtures) within 30 minutes of check-in. If no report is made during this time, any damages discovered after this period will be assumed to have occurred during the Guest’s stay, and the Guest will be held accountable for covering the cost of such damages. The Guest agrees to reimburse Nistula for any damages or breakages incurred to the property or its belongings throughout their stay.
Guests are expected to handle all aspects of the property—including its equipment, furnishings, and other assets—with care, ensuring no intentional, accidental, or negligent damage is caused. Upon check-out, the property should be left in a neat and reasonably clean condition, factoring in normal usage. If any part of a set is damaged (for example, one broken glass in a set of six), the Guest will be responsible for replacing the entire set. For larger damages, such as upholstery, the Guest will bear the cost of replacing all relevant parts (e.g., the upholstery of all sofas). Nistula will arrange the necessary repairs or replacements, and all related expenses will be charged to the Guest.
Guests are strictly prohibited from moving or rearranging any equipment, appliances, or furniture without prior consent from Nistula, except for easily movable items like chairs or lightweight furniture. Unauthorized relocation of items may result in the forfeiture of the full security deposit.
Nistula may not be able to conduct a detailed property inspection at the time of check-out. As a result, any potential refund of the security deposit, after accounting for damage costs, may not be immediate. The inspection will take place between the Guest’s check-out and the next Guest’s check-in. Nistula will endeavor to return the remaining security deposit within 4 working days following check-out. If any repairs or replacements are necessary, the costs will be communicated to the Guest, and Nistula’s assessment will be deemed final, with no requirement to seek the Guest’s approval for the associated costs.
If the repair or replacement costs exceed the security deposit amount, the Guest will be informed and required to pay the additional amount within 7 days of receiving the notice. Any security deposit refunds will be processed via cheque or bank transfer to the Guest’s designated account.
Moreover, Guests are responsible for ensuring that the property is left in an orderly state at the time of departure, with all appliances (such as air conditioners, heaters, lights, and fans) switched off and any furniture returned to its original position. Failure to do so may result in additional cleaning fees and applicable taxes.
During the rental period, the Guest has full access to and enjoyment of the property and its amenities. However, from time to time, staff or contractors may need to access the premises for necessary tasks such as maintenance of the property, garden, swimming pool, utilities, or for providing any additional services requested by the Guest. The Guest agrees to grant reasonable access to the property whenever such services or maintenance activities are required.
All reservations are presumed to be made for vacation purposes only, and the Guest agrees that the Property’s use will be limited to this purpose unless otherwise agreed in writing. If the Guest intends to host an event, such as a wedding or party involving a large number of people at the Property, or plans to use the Property for purposes other than a vacation, it is essential to notify Nistula at the time of booking, as special permissions or arrangements may be necessary. Depending on the nature of the event, a surcharge and/or an additional security deposit may be required, which will be agreed upon and confirmed in writing before the reservation is finalized.
Some Properties are located in residential areas or estates with specific rules and regulations regarding their use. As a result, certain activities or uses may not be permitted due to these or other factors outside Nistula’s control.
If Nistula confirms a reservation that includes an event at the Guest’s selected Property, in some instances, the Guest may be required to obtain permits from the local authorities or community before the event can take place. The Guest acknowledges and agrees that Nistula has no control over the issuance of such permits. If the authorities or community decline to issue a permit for the event, Nistula will not provide any refund for the event fee paid by the Guest.
Nistula is dedicated to helping you plan and organize various aspects of your event, including decor, in-villa catering, entertainment, photography, and any special requests, all of which require prior approval. We collaborate exclusively with a curated list of vendors who are well-versed in our house rules and policies. The use of external vendors at our villas is strictly prohibited. Failure
